Terms of Use

These Terms of Use (“Terms”) govern your use of the Blan app (“the App”) provided by Nixes (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Blan helps you plan your day in blocks of time. Depending on your subscription, it can also block distracting apps while a block runs, suggest changes to your plan using artificial intelligence, import calendar events and show insights about how you spent your time. Our Privacy Policy explains how we handle information.

2. Your plans are yours to decide

Suggestions, insights and other content generated by the App, including by AI, may be incomplete or inaccurate. They are not professional advice of any kind. You remain responsible for your plans and decisions.

3. App blocking

App blocking relies on Apple’s Screen Time features and the permissions you give. It may not work in every situation, for example if permissions are changed or if iOS limits it, and you can unlock apps yourself. Do not rely on the App for anything where a failure to block could cause harm.

4. Acceptable use

You agree not to misuse the App or its services. This includes trying to get around usage limits or purchase checks, interfering with our servers, using the AI features to create unlawful or harmful content, or reverse-engineering the App, except where the law allows it.

5. Subscriptions and payments

Blan Pro. Some features require a Blan Pro subscription. Prices and plans are shown in the App before you buy.

Billing. Subscriptions are purchased and billed through Apple’s App Store, under Apple’s terms. Payment is charged to your Apple Account when you confirm the purchase.

Free trial. Where a free trial is offered, the subscription starts and is charged when the trial ends, unless you cancel at least 24 hours before it ends.

Renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends.

Managing and cancelling. You can manage or cancel your subscription in your device’s Settings, under your Apple Account’s Subscriptions.

Refunds. Refunds are handled by Apple under its policies.

6. Fair use

To keep the service available for everyone, AI features may be subject to usage limits, which we may change from time to time.

7. Intellectual property

The App, its design, code and content are owned by Nixes and its licensors. We grant you a personal, limited, non-exclusive, non-transferable license to use the App on Apple devices that you own or control, as permitted by these Terms and Apple’s Usage Rules.

8. Your content

You keep ownership of the plans, checklists and other content you create in the App. When you use features that send content to our services, such as the AI features, you allow us and our service providers to process that content only to provide those features to you.

9. Availability and changes

We work to keep the App available but do not guarantee that it will be uninterrupted or error-free. We may change, suspend or discontinue features at any time. We may update these Terms from time to time; the “Last updated” date shows when they last changed, and continued use of the App means you accept the updated Terms.

10. Disclaimer and limitation of liability

The App is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any loss of data, time or productivity, arising from your use of or inability to use the App. Nothing in these Terms limits rights you have under consumer protection laws that cannot be limited by contract.

11. Termination

We may suspend or end your access to the App’s online services if you break these Terms or misuse the service. You can stop using the App at any time by deleting it.

12. Apple

These Terms are between you and Nixes only, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, consumer protection claims, or claims that the App infringes a third party’s intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Nixes operates, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise.
